Family Law Attorney in Delaware County Advocates For “Essential” Kayden’s Law

Kayden's Law puts children's safety at the forefront when their parents are in the middle of custody battles and disputes. The law would provide protection to them when parents have a history of violence according to Arik Benari, a Family Law Attorney in Delaware County.

Kayden Mancuso’s father killed her last year when she was just seven years old – and now her mother is trying to pass a law in her name. Kathryn Sherlock and her current husband, Brian, have met with Governor Tom Wolf to get his support for their Kayden’s Law, a law that will better protect children from parents who have histories of abuse.

“Unfortunately, we see people whose hatred of their former partners far surpasses their care for their children,” Arik Benari, of The Benari Law Group comments:“While lawyers who work within family law and child custody try to fight for those children and keep them in the safest situations, the law does sometimes fall short.”

Kayden’s mother tried to keep the young girl away from her father, however, because he had not displayed aggression or abuse toward his daughter (but did have documented abuse toward others), he was granted court-approved custody. It was during one of those visits that he killed his daughter and then killed himself.

“Cases don’t have to result in death to be heartbreaking, though that is the worst possible outcome,” Benari continued. “The system failed Kayden and hopefully this law will prevent it from happening to others. This law would prevent parents who have a history of abuse from being alone with the child until it is proven he or she can be trusted to be alone with the child. Hopefully, the law will lead to supervised visits, therapy, and training programs.”
